James Benjamin

in memoriam

Our much loved friend and chamber mate of Halsbury Chambers passed away in March 2024.

James was first admitted to the profession as a solicitor before being called to the bar in 2006. He commenced his career as a barrister in the role of in-house counsel at Legal Aid Queensland. During this time, he developed expertise in criminal defence with a commitment to social justice and a speciality in Youth Justice matters.

After commencing at the private bar in 2016, he continued to strive to protect the rights of the most vulnerable people in our community and his practice grew in both trial and appellate advocacy.  He was an active and valued member of the Association’s Criminal Law Committee.

James practised primarily in criminal law but also had experience in child protection including at an appellate level.  During his time at Legal Aid Queensland and since commencing in private practice he had significant experience in complex matters before the Mental Health Court.  He appeared regularly in a wide variety of criminal matters in the superior courts throughout Queensland, including the Court of Appeal.

James had a particular interest in the interaction that children have with the legal system.  This includes the youth justice system, the child protection system and children appearing as witnesses. He has represented the Bar Association of Queensland on the Childrens Court Committee and he contributed regularly to submissions on proposed legislation and policy initiatives relating to children’s participation in the criminal justice system.

When he was not practising law, James enjoyed having fun with his wife and two boys, music and coaching and volunteering with his local Junior AFL Club.

James’ memory will live on for all at Halsbury Chambers. To honour his contribution to our Chambers, Halsbury Chambers offers a readership program in his name.

The James Benjamin Readership is offered to new barristers for an initial six month period. In this way, we, and those who benefit from this opportunity, honour James’ memory.
